Allgemeines

Vordruck D-2 beinhaltet die Schiedsvereinbarung von Lizenzinhabern mit dem Deutschen Volleyball-Verband. Alle Streitigkeiten, die sich in Zusammenhang mit für den DVV geltenden Anti-Doping-Bestimmungen (World Anti-Doping Code „WADC“, Nationaler Anti-Doping Code „NADC“, Anti-Doping-Bestimmungen der FIVB und der CEV sowie des DVV), insbesondere über die Gültigkeit und Anwendung dieser Anti-Doping-Bestimmungen, ergeben, werden unter Ausschluss des ordentlichen Rechtsweges in erster Instanz durch das Deutsche Sportschiedsgericht der Deutschen Institution für Schiedsgerichtsbarkeit e.V. (DIS) nach der Sportschiedsgerichtsordnung der DIS (DIS-SportSchO) und den Verfahrensvorschriften der Anti-Doping-Bestimmungen, insbesondere Art. 12 und Art. 13 ADO entschieden. Die Schiedsvereinbarung regelt die ausschließliche Zuständigkeit der Rechtsinstanzen DIS und CAS.

Vordruck D-2 ist unmittelbar bei erstmaliger Beantragung einer Lizenz (Spieler, Trainer, Co-Trainer, Scout, Arzt, Physio), spätestens jedoch 14 Tage nach dem ersten Spiel, in zweifacher Ausfertigung, beide Exemplare eigenhändig unterschrieben, im Original an die Volleyball Bundesliga zu senden. Die Schiedsvereinbarung ist unbegrenzt gültig, auch bei Vereinswechsel.

Sollten rechtliche Änderungen eine Aktualisierung von Schiedsvereinbarungen erfordern, wird der DVV die Schiedsvereinbarung kündigen. Bei Neubeantragung/Verlängerung von Lizenzen werden Lizenzinhaber sodann aufgefordert, eine neue Schiedsvereinbarungen einzureichen.

In addition to the athlete agreement „Anti-Doping“, the DVV and athlete agree on the following arbitration clause:

1. All disputes that arise out of the for the DVV current anti-doping regulations (World Anti-Doping Code „WADC“, National Anti-Doping Code „NADC“, anti-doping regulations oft he FIVB and CEV), especially of the validity and application of these anti-doping regulations, are decided at first instance by the Deutsche Sportschiedsgericht of the German institution for Schiedsgerichtbarkeit e.V. (DIS) according to the Sportschiedsgerichtordnung of the DIS (DIS-SportSchO) and the rules of procedure of the anti-doping regulations without recourse to the ordinary courts of law, especially according to Art. 12 and Art. 13 ADO. This also applies for disputes in interim relief.

2. The power of the sentence of sanctions due to violations of anti-doping regulations is delegated to the DIS.

3. The DVV has transferred the implementation of the result management and the right to initiate disciplinary proceedings in anti-doping issues to the national anti-doping agency of Germany (NADA). The parties of this arbitration agreement acknowledge that the NADA can lodge a direct arbitration action against the athlete/the advisor and is party in a relevant arbitration.

4. Appeals against arbitrations of the DIS: Court of Arbitration for Sport (CAS) in Lausanne, according to § 61 DIS-SportScho, art. 13 ADO and art. R47ff oft he Code of Sports related Arbitration (CAS-Code). The parties of this arbitration agreement acknowledge that also NADA, WADA, FIVB and the other sport organisations named in art. 13.2.3 ADO can lodge direct appeals and thereby can become a party in an appeal procedure.
